Definitions

Limitation of liability

To the maximum extent permitted by applicable law, we will not be liable for any indirect, incidental, special, consequential or punitive damages, lost profits, lost data, lost opportunities or loss of goodwill arising out of the use of, or inability to use, the Service. Our aggregate liability for any claim relating to the Service shall not exceed the amount paid by you to GPDC PROPERTIES S.L.U in the 12 months preceding the event giving rise to the claim, or EUR 100 if no payments were made. Nothing limits liability for wilful misconduct, gross negligence, fraud or for death or personal injury where mandatory law does not allow exclusion.

Indemnification

You agree to indemnify and hold GPDC PROPERTIES S.L.U, its officers, employees and agents harmless from any claim, damage, liability, cost or expense (including reasonable legal fees) arising from your use of the Service, your content or your breach of these Terms or applicable law.

Force majeure

We will not be liable for delays or failures arising from causes beyond our reasonable control, including acts of God, force majeure, failures of public networks, cyber-attacks, governmental actions, labour disputes, pandemics or armed conflict.

Changes to these terms

We may change these Terms at any time. The current version is published on this page with the date of the latest update. Material changes will be notified through the usual channels (for example a banner on the site or email) with reasonable advance notice. Continued use of the Service after the changes take effect constitutes acceptance of the new Terms.

Severability and entire agreement

If a competent authority finds any provision of these Terms void, invalid or unenforceable, the remaining provisions will continue in full force. Failure to enforce a right does not constitute a waiver. These Terms, together with the Privacy Policy and Cookie Policy, constitute the entire agreement between the parties regarding the Service.

Governing law and jurisdiction

These Terms are governed by the laws of the jurisdiction where GPDC PROPERTIES S.L.U is registered, without regard to conflict-of-law principles. The courts of that jurisdiction will have competence to resolve any dispute, without prejudice to the mandatory rights of consumers to bring proceedings before the courts of their place of residence.
